The police has asked us to post the following notice for the upcoming trial:
INFORMATION FOR THE MICHAEL SCHMIDT
(RAW MILK) TRIAL
The trial for
Michael Schmidt is scheduled for courtroom T2, 26 Jan 2009. There are a
few things about the courts that have to be considered if you are planning on
attending.
1) The courtroom itself will only hold
approximately 45 people. This includes the prosecutors, defense and
defendants, and other court staff. This will leave a very limited area for
gallery members. It is requested that if you do attend inside the
courtroom, please keep quiet while court is in session. Please turn off
all cell phones and pagers. Rise when the Justice of the Peace enters and
exits the courtroom. Please remove hats and headdress (religious headdress
excepted). If you are asked to leave the courtroom for any reason by court
staff, court officers, or the Justice of the Peace, please do so respectfully
and quietly.
2) The hallway outside the courtroom is
only able to accommodate 20 people as per fire code. This hallway also
leads to courtroom T1, so there will be people outside of this courtroom who
have business to deal with. Please respect their right to be there and
deal with their court issues.
3) Outside the hallway is an
administrative area which contains no room for supporters of Mr.
Schmidt.
4) The upper part of the Tannery Mall is
used by cardiac patients 3 days a week. They walk laps and get their heart
rate monitored. Please DO NOT interferes with these walkers as they have
booked the area and use it weekly.
5) The Tannery Mall invites people to
remain within the mall, but asks that conversations be kept respectfully low as
sound carries within the common area of the mall. The Tannery is not a
commercial mall, and leases space to businesses and government offices.
Please do not clog the hallways or interfere with the daily operations of these
businesses.
6) If you are asked to leave the Tannery
Mall by security, mall staff, or York Regional Police – please follow their
directions and leave the Tannery Mall accordingly. If you do not leave the
Tannery Mall as directed, you may be subjected to charges under the Trespass to
Property Act

2. (1) Every
person who is not acting under a right or authority conferred by law and
who,
(a) without the express
permission of the occupier, the proof of which rests on the
defendant,
(i) enters on premises
when entry is prohibited under this Act, or
(ii) engages in an
activity on premises when the activity is prohibited under this Act;
or
(b) does not leave the
premises immediately after he or she is directed to do so by the occupier of the
premises or a person authorized by the occupier,
is guilty of an offence
and on conviction is liable to a fine of not more than $2,000. R.S.O. 1990,
c. T.21, s. 2 (1).
7) If you would like to rally or present
placards or the like, the area of Mabel Davis Conservation Area (located east of
the Tannery Mall) is available as a green space close to the courts. York
Regional Police requests that this area be used as it provides a visible, but
safe area in which to convey a message of support. If a public display of
support is too be held, YRP wishes to assist it in being safe and law-abiding,
so that the message can be received properly.
8) Parking is an issue at the Tannery
Mall. It is requested that parking for The Raw Milk Trial be at the
overflow parking west of the mall.

I would like to appalud the forgotten Mr. Rudy Kowarsky, the Justice who rendered the verdict in Mr. Schmidt's case, and without whose clear understanding of the very dangerous implications of upholding the charges filed against Mr Schmidt, we who celebrate this affirmation of personal liberty and choice, would be outraged at a grave violation of the Charter, and a monstrous example of hypocrisy and double-speak. I should underscore, that this is the perspective of someone still un-convinced that in respect of nutritive properties for human consumers, raw non-human milk is vastly superior to its pasteurized counterpart, all things otherwise being equal; I am convinced, however, that those willing to sell raw milk as a general rule set for themselves very lofty standards of animal husbandry and welfare, knowing full well that the likelihood of infection secondary to consuming such milk, is infinitesmal.
Compulsory pasteurization can certainly compromise milk quality and impart a false sense of security not only to the consumer, but to countless health professionals who seldom even dream that ordinary pastuerized milk, with a seemingly endless 'shelf life' in an insulted modern refrigerator, can cause repeated and serious infection.
Congratulations, Michael! Your perseverance and courage of conviction is exemplary, and has inspired me to keep my nose to the grindstone.
